    2. Your use of Stockland Benefits + Program Services and Benefits is made at your own risk. We may, from time to time, change or add to this website (including these terms of use) or the information, products and services without notice. We are not liable to you or anyone else if errors occur in the information on this website or if that information is not up-to-date.
  2. Disclaimer and Warnings

    1. The Stockland Benefits + Program website will not be liable for any damages to or any viruses, which may affect your computer on account of your access to this website.
    2. We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of this website or linked websites.

  3. Terms and Conditions – Membership Enrolment

    Yes, I understand and agree that by activating my membership I will receive complete and full access to all the benefits offered in the Stockland Benefits + Program for the duration of the program.

    I also understand that I can cancel my membership at any time by giving 30 days written notice or by advising the Stockland Benefits + Program via the phone line or email address.

  4. Terms & Conditions – Ongoing Membership Agreement

    1. Definitions in this Agreement
      1. `We`, `our` and `us` means Stockland Development Pty Limited (Stockland).
      2. ‘Voucher’ means the Stockland Benefits + Program pre-purchased cinema tickets/ store-cards/ box office tickets provided by Stockland via the Stockland Benefits + Program website.
      3. `You` and `your` means the member that is the person with a current Benefits + Program membership
        number.
      4. `The Services` and `Benefits` means the Stockland Benefits + Program services and benefits provided by Stockland.
    2. Acceptance
      1. Use of the Services and Benefits by you constitutes your agreement to the Terms and Conditions, which shall govern the
        provision of the Services and Benefits.
    3. No Warranties
      1. There is no warranty that any information or service provided or referenced by this website is either merchantable or accurate, that such information or service will fulfil any of your particular purposes or needs, or that such information or service does not infringe on any third party rights.
      2. While Stockland uses reasonable efforts to include accurate and up-to-date information on the Stockland Benefits + Program website, Stockland makes no warranties or representations as to its accuracy.
      3. Stockland may periodically add, change, or improve any of the information, products, services, programs and technology described on the Stockland Benefits + Program website without notice.
      4. Stockland assumes no liability or responsibility for any errors or omissions in the content of the Stockland Benefits + Program website.
    4. The Services
      1. By signing up through this internet website, you are entitled to use the Stockland Benefits + Program Services and you agree that you will use the Services only for your own benefit.
      2. The supplier of the Services and Benefits reserves the right to change, modify or cancel the offer without notice. *To access up-to-the minute offer details refer to this website. If you are unable to log on, call the Stockland Benefits + Program phone line or email the email address.
      3. Stockland Benefits + Program reserves the right to change, modify or cancel voucher offers without notice. To ensure that all our members have equal and ongoing access to vouchers a Fair Usage Policy applies to the purchase of voucher items. Stockland reserves the right to not accept orders that it considers fall outside the Fair Usage Policy. Monthly and annual order maximums apply.       4. Stockland and its suppliers also reserve the right to change pricing on products and handling fees and to modify or remove a product without notice.
      5. All voucher purchases are subject to a fulfilment period displayed on the website while making purchases.
      6. Members who elect to purchase vouchers do so on the unconditional understanding of the possible delivery timeframes, possible associated charges, Fair Usage Policy and order maximums that apply.
    5. Third Parties
      1. It is a condition of membership that you consent to providing information about yourself to any third party contracted by us to provide Services and Benefits to you. All third parties have entered into agreements with us governing the use, disclosure and protection of members’ personal information.
      2. Stockland will not be liable for any mistake, failure or negligent action on the part of any external party contracted with us to provide benefits.
      3. Members agree to enter into any arrangement with a supplier at their own risk.
      4. Third party suppliers reserve the right to change, modify or cancel any offers without notice.
    6. Termination
      1. You may terminate your membership at any time by giving written notice to us.
      2. We may terminate your membership at any time by giving written notice to you.
      3. Termination will not affect obligations incurred before the termination.
    7. Electronic Listings and Advertisements
      1. Stockland does not accept responsibility for the accuracy of any listing or advertisement published and disclaim all liability to advertisers, users and readers of any kind of loss or damage as a result of inaccuracy, error or omission.
      2. The copyright in all listing or advertisements appearing in Stockland Benefits + Program products shall be owned by the third party company supplier who listed their respective advertisement on the website.
      3. The linked websites referenced on the Stockland Benefits + Program website are provided for convenience only and may not remain current or be maintained. Links to linked websites should not be constructed as an endorsement, approval, recommendation, or preference by Stockland of the owners or operators of those websites, or for any information, products or services referred to on those websites.
    8. Trade Marks
      1. Other product and company names mentioned on this website may be the trademarks of other people or entities.
    9. Personal Information

      2. Any notice to be given to you will be sent by prepaid post addressed to you at the last address notified by you to us.
  5. Stockland Benefits+ Program Fair Use Policy

    Our Fair Use Policy is intended to ensure that our members do not use our services, products or offers in an excessive, unreasonable or fraudulent manner. Such use may impact the quality or reliability of our services, products or offers to other members. Our Fair Use Policy applies when you use any of our services, products or offers. We retain the right to vary the terms of the Fair Use Policy at any time in our sole discretion. The Fair Use Policy (as varied from time to time) is available at the Stockland Benefits + Program website and any variation takes effect immediately any such variation is posted on our website.

    Excessive Use

    You must not use any of our services, products or offers in a way that we deem to be excessive (in our sole discretion). In relation to pre-paid store cards:

    We consider that purchasing more than $2,000 of pre-paid store cards (for all stores combined) in any one calendar month or

    more than $24,000 of pre-paid store cards (for all stores combined) in any 12 month period is excessive use. Any use over these amounts is deemed excessive.

    We will notify you if we deem your use to be excessive, and in breach of our Fair Use Policy and may ask you to reduce your purchase accordingly.

    If you continue to attempt to use the service at excessive levels following this request, we may suspend or cancel your access to the services, products or offers immediately and without any prior warning or notice given to you.

    You must not use any of our services, products or offers in a way that we deem to be excessive.

    Unreasonable and Commercial Use

    Without restricting what is meant by “unreasonable” we will supply services, products and offers to you for the purpose of your own personal and domestic use only. We will consider unreasonable use of the services, products or offers to be:

    1. Using the services, products or offers for business or commercial purposes;

    2. Wholesale sale or distribution of the services, products or offers to any other person or entity.

    Where we consider your use of the services, products or offers is for business or commercial purposes we will notify you and ask you to modify your use of the services, products or offers. If you do not modify your use of the services, products or offers we may suspend or cancel your access to those services, products or offers immediately and without any prior warning or notice given to you.

    Without any limitation, we consider in our sole discretion, that the following uses are uses for business or commercial purposes and outside the Fair Use Policy:

    1. You purchase services, products or offers for the purposes of resale, resupply or commercial exploitation; or

    2. You purchase services, products or offers to use as payment to third parties for other services supplied to you; or

    3. You purchase services, products or offers for reasons other than for reasonable personal or domestic use; or

    4. You purchase services, products or offers to use in your business or a direct family member’s business; or

    5. You purchase services, products or offers to be provided as prizes, commission, compensation or incentives in a competition, promotion or offer.

  6. Consent and Stockland Privacy Policy

    Yes, I understand and agree that by activating my membership I am also consenting to Stockland using my personal information for the purpose of providing the Services and Benefits that I may purchase under the Stockland Benefits + Program from time to time or any other program that Stockland may offer.

    As a valued Member, Stockland wants you to know that Stockland is committed to protecting your privacy. Stockland’s privacy policy is available at www.stockland.com.au/privacy-policy.htm.

    How Stockland collects information.

    The personal details Stockland collect include your name, address, telephone numbers and information required for servicing your membership. These are sourced from the details you enter while using the Benefits + Program website. No information of a sensitive nature is collected or stored.

    How we store your information.

    All your personal details are stored in a single, secure database. Access is controlled and limited to Stockland staff engaged to operate the Stockland Benefits + Program or to provide goods or services in connection with the Stockland Benefits+ Program.

    How accurate is the information we hold?

    Stockland will make every effort to keep members’ details accurate and up-to-date. Information is immediately updated if errors or changes are brought to our attention, which is why Stockland recommend that you let us know straight away if you find errors in your personal information. Keep us informed of changes to such personal information as your name, address or telephone number.

    Do we disclose your details to anyone else?

    Other than as noted under these Terms and Conditions, no personal information is otherwise disclosed to third parties.

    How do you gain access to your personal information?

    It is your legal right to know exactly what personal information of yours Stockland holds. You may request in writing for Stockland to supply the Member information it holds about you to you.

    How you can opt out of being contacted?

    As part of an ongoing program of communication, members are contacted by email to inform them of upcoming events or special product offers, or to gather feedback on our various products and services. If you would prefer not to be contacted in one or more of these programs, you can “opt out” by unticking the email newsletter form. Your preference will then be recorded on our database for future reference.

  7. Disclosure of Benefit

    Stockland may from time to time, receive discounts or other benefits from third party supplier(s) who may be invited to offer goods or services to you as a member of the Stockland Benefits + Program.
